Compensation Policy: Set Out a Fair, Consistent Approach to Pay

A compensation policy explains how your organisation sets and reviews pay, what bonuses, incentives and benefits you offer, how you keep pay fair and lawful, and how employees can raise a question about their pay. Robot Lawyer drafts the policy from your answers, for the law of the country or state you choose, and on the Verified plan a qualified legal professional checks it within 24 hours before you share it with your team.

What Is a Compensation Policy?

What Is a Compensation Policy?

A compensation policy (sometimes called a pay or reward policy) sets out the principles and processes behind pay decisions. It covers base pay, any salary bands, performance-related pay, bonuses, benefits and pay reviews.

A clear policy helps you make consistent decisions, explain them to employees, attract and keep good people, and reduce the risk of unequal pay claims.

When Do You Need One?

  • Growing organisations
When pay decisions move beyond the founders and need consistency.
  • Introducing pay bands or bonuses
    To explain how they work.
  • Pay equity reviews
When you want to check and explain fair pay.
  • Multiple locations
Where pay varies by region or country.
  • Pay transparency
Where the law or your culture expects openness about pay.

What's Included in Your Policy?

  • Policy details
Your organisation's name and address, who to contact, who owns the policy, its effective date, version and next review date.
  • Principles
    Fair, consistent, non-discriminatory pay decisions.
  • Pay structure
How pay is set, including any bands or grades.
  • Performance and progression
    How performance affects pay.
  • Bonuses, incentives and benefits
The rewards you offer and where their terms are set out.
  • Pay reviews
    How often pay is reviewed.
  • Pay equity and transparency
Equal pay, checking for gaps, and discussing pay.
  • Pay queries
How employees can raise a question or concern.
  • Optional forms
A salary review form and a pay query form, if you want them.

How It Works in Different Countries

  • UK
Employers must pay at least the National Minimum Wage or National Living Wage and give equal pay for equal work under the Equality Act 2010. Employers with 250 or more employees must publish gender pay gap figures.
  • EU and Ireland
The EU Pay Transparency Directive is bringing new pay transparency rules, and Irish employers with 50 or more employees must report on their gender pay gap.
  • United States
Federal and state laws set minimum wage, overtime and equal pay rules. Several states, including California, Colorado, New York and Washington, require pay ranges in job adverts.

These notes are general. Check the current rules where you employ people.

Compensation Policy FAQs

Is a compensation policy a legal requirement?

Usually not, but pay must meet the law, and a written policy helps you show your decisions are fair and consistent.

Should bonuses be discretionary?

That's your choice. Your policy describes your bonus plans as you set them up, and the detailed terms belong in the plan rules or contracts.

Can employees discuss their pay?

In many countries, employees are protected when they discuss pay to find out whether it is fair. Your policy reflects the rules where you operate.

How often should we review pay?

Many organisations review pay once a year. Your policy uses the frequency you choose and makes clear a review doesn't guarantee an increase.

Can I use this policy outside the UK?

Yes. Your policy is drafted under the law of the country or state you choose. Our lawyers are qualified in England and Wales and, on the Verified plan, check documents for good practice, clear formatting and the law of England and Wales. They are not qualified in other countries' law, so if your policy is governed by another country's law, we recommend having a local lawyer check it too.
