Letter Before Legal Action: Create a Verified Letter Before Claim
A verified letter before legal action, also called a letter before claim or letter before action, is the formal letter you send before starting court proceedings. It explains your claim, what you want the other side to do and the deadline for a reply, and warns that you may go to court without further notice. Robot Lawyer drafts it from your answers and follows the pre-action rules of the governing law. On Premium, a legal professional checks it before you send it.

What Is a Letter Before Legal Action?
It is the last step before court. The letter tells the other party (the respondent) exactly what the claim is and gives them a fair chance to pay, put things right or respond before you issue a claim. In many legal systems it is expected, and in some it is required, before you can start proceedings.
Outside the UK, a similar letter is often called a demand letter or a pre-litigation letter. If you simply want to ask for payment without referring to court rules, see our Demand Letter.
When Do You Need One?
- Unpaid invoices and debts
A customer or client hasn't paid what they owe. - Faulty goods or poor services
A supplier or trader won't refund, repair or put things right. - Breach of contract
The other side hasn't done what the contract required. See also our Breach of Contract Letter. - Deposits and money held back
A deposit or other money is being withheld without good reason. - Property and neighbour disputes
Damage or losses that the other side refuses to pay for.
Pre-Action Rules in England and Wales (UK Only)
In England and Wales, the courts expect parties to follow the Practice Direction on Pre-Action Conduct and Protocols before issuing a claim. A court can penalise a party who doesn't, for example through costs orders.
- Most claims
The letter should set out the claim clearly and allow a reasonable time to reply, usually 14 days in a straightforward case and up to three months in a complex one. - Debts owed by individuals
Where a business is claiming a debt from an individual, including a sole trader, the Pre-Action Protocol for Debt Claims applies. The letter must include specific information, enclose a reply form and an information sheet, and give the debtor 30 days to reply. - Specific protocols
Some claims, such as personal injury or professional negligence, have their own protocol with extra requirements.
Your letter follows the right approach based on your answers. Scotland and Northern Ireland have their own court rules, and your letter reflects the governing law you choose.
What's Included in Your Letter?
- The parties
The claimant's and respondent's names and addresses, with the right greeting and sign-off. - The date
Clearly shown at the top, as deadlines run from it. - Summary of the claim
What happened, in date order, from your answers. - The legal basis
Why the respondent is responsible, described in the governing law's terms, such as breach of contract or an unpaid debt. - What you want
The amount claimed, how it is made up, or the action you want taken. - The deadline
A date for a reply that meets the minimum period for the governing law. - Documents and next steps
Any key documents you refer to, a reference to resolving the dispute without court where appropriate, and that proceedings may be issued without further notice if the matter isn't resolved.

Letter Before Legal Action FAQs
How do I write a letter before action?
State who you are, what the dispute is, why the other side is responsible, exactly what you want and the deadline for a reply. Keep it factual and polite, and say that you may start court proceedings without further notice if the matter isn't resolved. Robot Lawyer builds the letter from your answers.
How long should I give someone to respond?
UK only: in England and Wales, 14 days is usual for a straightforward claim, and 30 days for a debt claim against an individual under the debt protocol. Elsewhere, give a reasonable period and check any local rules.
Is a letter before action legally required?
In England and Wales, the courts expect it before most claims, and failing to send one can affect the costs you recover. In other countries the position varies, but a clear letter is almost always a sensible first step.
Can I send a letter before action to an individual?
Yes. If you are a business claiming a debt from an individual in England and Wales, the letter must follow the Pre-Action Protocol for Debt Claims. Robot Lawyer applies the protocol's content and 30-day deadline from your answers and lists the forms you need to enclose, such as the Information Sheet, Reply Form and Financial Statement.
Can I send a letter before action by email?
Yes, if you have used email with the other party before or they have given an email address for correspondence. For important claims, also send it by tracked post.
What happens if there is no reply?
You can consider issuing a claim. In England and Wales, smaller money claims can usually be started online through the courts' Money Claim service. Keep a copy of your letter, as the court may ask whether you followed pre-action conduct.
