What is the Lasting Power of Attorney?
A Lasting Power of Attorney (LPA) is a legal arrangement that allows you to designate a trusted individual, known as an attorney, to make important decisions on your behalf if you’re unable to make them yourself due to illness, injury, or loss of mental capacity. There are two types of LPAs:
1. Health and Welfare LPA: This allows the attorney to make decisions about your personal healthcare, medical treatment, daily routines, and even where you live. This type of LPA can only be used when you’re no longer able to make decisions for yourself.
2. Property and Financial Affairs LPA: This allows the attorney to manage your finances, including paying bills, managing bank accounts, and even selling property. Unlike the Health and Welfare LPA, it can be used immediately with your consent, even if you still have the capacity to make decisions.
